1. Definition
These terms are applicable to all agreements made and/or orders placed through, but not limited to, the internet or orderform with Initialmedia bv. These terms are applicable to everyone ordering products and services or other means of information and to everyone subscribing to any of our products.
2. Pricing
All pricing of books and subsciptions are inclusive of 6% VAT and exclusive of handling- and shippingcosts (unless stated differentely) and are published with reservation of any changes.
3. Delivery
All deliveries will be, if in stock, sent as soon as possible but no later than 4 weeks after receiving the order. Any delay in delivery does not give any right to reimbursement. With any delivery handling and shippingcosts can be charged.
Delivery will only take place in the Netherlands through services of third parties, e.g. TPG Post. We do not accept any responsibilities for the services of third parties.
4. Claims and Responsibilities
Customers are to check their order upon delivery. In case of any claims one needs to notify Initialmedia bv in writing within eight (8) days after delivery. After this term the customer has accepted the order.
If it is proved that the order has not been delivered as agreed, Initialmedia bv has a choice to replace the order or to compensate the buyer limited to the invoice value of the product(s) or service(s) involved in the order.
5. Payment
All orders will be delivered with a term of payment of 15 (fifteen) days, without any discount, clearance or others unless differentely agreed in writing. Customer will receive an acceptgiro or invoice to make the payment. When delaying the term of payment, customer is in default and Intialmedia bv has the right to charge interests and costs.
If Initialmedia bv, after passing the term of payment, needs to send a reminder, customer will be charged a maximum administration fee of € 50,00. If, after sending a reminder, payment does not take place, Initialmedia has the right to hand the recalculated claim to a third partie in order to collect the full claim. All involved costs, legal and out of court, will be charged to buyer.
All abovementioned terms are applicable if payment has been made throught creditcard or bank authorization and this payment is rejected by client or clients’ bank. In that case an acceptgiro or invoice will be send to client with supplement of forementioned administrationcosts with a maximum of € 50,00. Initialmedia bv can, at all times, decide to outsource all creditcard transactions, bankauthorizations and invoicing of orders to third parties.
6. Communications
Initialmedia bv is not reponsible for wrongly or delayed information regarding orders made through, but not limited to, the internet.
7. Copyright
All rights, including copyright and database right, in Initialmedia’s website and its contents, are owned by or licensed to Initialmedia bv, or otherwise used by Initialmedia bv as permitted by applicable law.
In accessing the Initialmedia web pages, you agree that you will access the content solely for your own private use but not for any commercial or public use. You can download and use the service on a single CPU at a time, and you can print out a single hard copy of any part of the content on the website for your personal use.
Except as permitted above, you undertake not to copy, store in any medium (including in any other website), distribute, transmit, re-transmit, broadcast, modify, or show in public any part of Initialmedia’s website without the prior written permission of Initialmedia bv.
8. General
Regardless her rights Initialmedia reserves the right to reject or terminate agreements or orders placed by, but not limited to, the internet.
In the event that Initialmedia has allowed amicable changes in these terms and conditions, for a short or longer period, the right remains reserved to demand full compliance of these terms and conditions. On all agreements Dutch Law will be applicable.
